Decisions:

Moved by the Chair (the Lord Mayor), seconded by Councillor Scully -

It is resolved that:

(A)      the variation sought to the height of building standard in accordance with Clause 4.6 'Exceptions to development standards' of the Sydney Local Environmental Plan 2012 be supported in this instance;

(B)      the requirement under Clause 7.20 of the Sydney Local Environmental Plan 2012 requiring the preparation of a development control plan is unreasonable or unnecessary in this instance;

(C)      authority be delegated to the Chief Executive Officer (CEO) to determine Development Application No. D/2017/1620, subject to receiving advice from the Heritage Council of NSW that the matters a) and b) included in their letter dated 8 August 2018 have been addressed; and

(D)      if the CEO determines to approve the application, then consideration be given to granting development consent, pursuant to Section 4.16(1)(a) of the Environmental Planning and Assessment Act 1979, subject to the conditions as detailed in Attachment A to the subject report (and the inclusion of any new General Terms of Approval provided by the Heritage Council of NSW).

Carried unanimously.

Reasons for Recommendation

The Central Sydney Planning Committee approved the application as:

(A)      The development the subject of the application is consistent with the objectives of the B8 Metropolitan Centre Zone for the reasons set out within the report.

(B)      The proposal is consistent with the objectives and controls for the site and the planning proposal which has the effect of a site specific DCP.

(C)      The proposal, subject to conditions, will not adversely impact upon the amenity of neighbouring properties.

(D)      The proposal, subject to conditions, will not impact upon the heritage item adjacent to the site.

(E)      The proposal is consistent with the terms of the planning agreement that is registered on the site.

(F)       The CEO will determine the application, subject to advice from the Heritage Council of NSW that items a) and b) included in its letter dated 8 August 2018 have been satisfied and in that granting any approval any revised General Terms of Approval from the Heritage Council be included.
