The Panel granted consent to Development Application No. D/2018/742 subject to the conditions set out in Attachment A to the subject report, subject to the following amendments (additions shown in bold italics and deleted text shown in strikethrough):

(2)          DESIGN MODIFICATIONS

The design of the building must be modified as follows:

(a)        The discharge point for the laundry exhaust is to be relocated such that it is not visible above the roof of the rear addition when viewed from Goodlet Lane, and is not to project beyond the boundaries of the site.

(b)        The externally mounted air conditioning units and associated conduits on the Cleveland Street elevation are to be removed and relocated behind the parapet. The applicant is also to make good all surfaces. 

The modifications are to be submitted to and approved by Council’s Area Planning Manager prior to the issue of a Construction Certificate.

Reasons for Decision

The application was approved for the following reasons:

(A)        The use is permissible with consent in the B4 Mixed Use zone.

(B)        The use as a sex services premises is considered to be in keeping with the character of the area given its broad mix of commercial uses.

(C)       The revised Plan of Management adequately addresses the operational, safety and security requirements of the premises.

(D)       The proposed rear addition is of an appropriate scale and is considered to be sympathetic to the heritage conservation area.

(E)        The Panel also required a condition to relocate the air conditioning units to remove visual clutter from the front of the building and to enhance the contribution of the building to the heritage conservation area.
