The Panel refused consent for Development Application No. D/2018/648.

Reasons for Decision

The Panel refused the application for the following reasons:

(A)        The proposal does not comply with the provisions of Clause 4.4 Floor Space Ratio (FSR) of the Sydney Local Environmental Plan with a proposed FSR of 2.14:1 exceeding the maximum 1:1 as prescribed by Clause 4.4.

(B)        The proposal does not comply with the requirements of Clause 4.6(3) of the Sydney Local Environmental Plan 2012 in that no formal request to vary the maximum permissible FSR under Clause 4.4 and 6.14 of the Sydney Local Environmental Plan 2012 has been provided.

(C)       The proposal fails to meet the objectives of Clause 6.14(1)(b) of Sydney Local Environmental Plan 2012 as it result in adverse amenity impacts through the additional floor space.

(D)       The proposed development fails to demonstrate design excellence in accordance with Clause 6.21 of Sydney Local Environmental Plan 2012 as it results in unacceptable bulk and scale and detrimental impacts on the streetscape on William Lane.

(E)        The proposed additional storey is in breach of the maximum permitted height in storeys and is inconsistent with Section 4.2.1 of the Sydney Development Control Plan 2012.

(F)        The application has not demonstrated that the proposal will not have detrimental impacts on the amenity of neighbouring properties by way of unacceptable visual impacts, and as such is inconsistent with the requirements of Section 4.1.3.1 and 4.1.3.6 of Sydney Development Control Plan 2012.

(G)       The proposed development is not in keeping with the future desired character of the area and is not considered to be in the public interest.
