It is recommended that the Committee endorse the following reallocation of parking on the western side of Forbes Street, Darlinghurst south of St Peters Street:

(A)      Between the points 7.5 metres and 28.5 metres as "Works Zone 7am-6pm Mon-Fri 8am-1pm Sat";

(B)      Between the points 38.5 metres and 71.5 metres as "Bus Zone 7.30-9am 2-6pm School Days" and "1P 9am-2pm Mon-Fri"; and

(C)      Between the points 71.5 metres and 97.5 metres as "No Parking 7.30-9am 2-6pm School Days" and "1P 9am-2pm Mon-Fri".

The proposed Works Zone is subject to the following conditions:

(D)      The Applicant must comply with the Works Zone conditions as stipulated in Schedule C of this agenda.

(E)      The Applicant must obtain separate approval from the City's Tree Management Team prior to implementation of the Works Zone.

(F)       The Applicant is not permitted to operate any part of a crane over a public road or hoist/swing goods from a Works Zone across or over any part of a public road by means of a lift, hoist or crane unless a separate approval has been obtained from the City's Construction and Building Certification Services Unit as required under Section 68 of the Local Government Act 1993 and Section 138 of the Roads Act 1993.

(G)      The Applicant must notify adjacent properties of the Works Zone at least 14 days prior to installation and must provide a telephone number of the supervisor responsible for the proposed Works Zone and include contact details in the notification letter to be distributed to affected stakeholders.

(H)      The Works Zone will only be installed upon approval of the Construction Traffic and Pedestrian Management Plan (CTPMP).

Background

The City invited feedback in December 2022 to evaluate the effectiveness of trial parking changes implemented in July 2022 to improve traffic and parking conditions during school afternoon pick-up times at the Sydney Church of England Girls’ Grammar School (SCEGGS) in Forbes and Bourke Streets, Darlinghurst.

The redevelopment of SCEGGS Wilkinson House is a State Significant Development (SSD-19989744) and conditional development consent was granted by NSW Department of Planning in August 2022.

In accordance with the development consent conditions, Grindley Constructions Pty Ltd has prepared a Construction Traffic and Pedestrian Management Plan (CTPMP) to document traffic and pedestrian management arrangements around the site. The CTPMP proposes a 21 metre Works Zone in Forbes Street in front of Wilkinson House, and conversion of some of the pick up and drop off spaces on the western side of Forbes Street to bus parking.

Background

On 19 December 2013, the NSW Government adopted the Sydney City Centre Access Strategy (Access Strategy). The Access Strategy will deliver a fully integrated transport network in Sydney’s City Centre that puts the customer first and meets the growing transport task. It will mean more people use public transport to access the City Centre and it will change the way people move around within it.


The Access Strategy considers all transport modes and demonstrates how trains, buses, ferries, light rail, cars, taxis, pedestrians and cyclists will interact in the heart of Sydney. The Access Strategy also provides a clear direction for how all the different transport modes will work together in the Sydney CBD to reduce congestion, provide for future growth and improve the customer experience.

Transport for NSW B Pole bus stop sign rollout program

Transport for NSW B Pole bus stop sign rollout program aims to provide customers and bus operators with a clear, safe and reliable Head of Stand location during all hours of operations of bus services across NSW. Many bus stops are devoid of such identification and in order for Transport for NSW to comply with applicable legislation, Head of Stand location B Pole signs are required.

Issues applicable to this memo

Seven bus stops are required to have their existing Bus Zone signs, and in most cases, accompanying No Stopping signs relocated. This has occurred due mainly to the final location of QMS shelters.

QMS is the new owner of street furniture in the Sydney LGA.

In one instance, a stop is required to be relocated due to the introduction of a new signalised pedestrian crossing.

The specific issues and their proposed solutions for each stop are provided in the following:

 

Bus stop 201035 – Former location name ‘Surry Hills Childrens Court, Albion St’.

New location name ‘Albion St after Mary St, Surry Hills’

Issue:

Buses are not able to pick up or set down at the former location due to the establishment of a signalised pedestrian crossing being introduced nearby. Therefore, this location is to be discontinued and a new stop established.

The block immediately west and down grade of the current location bounded by Commonwealth and Mary streets is proposed.

Proposed solution:

To establish a new stop on Albion St bounded by Commonwealth St to the east and Mary St to the west. It is located at 54 Albion St and the Head of Stand B Pole will be situated 1950mm to the east of an existing seat.

Currently the proposed location is within a periodic Clearway and No Parking zone at all other times. No Stopping zones apply before the No Parking zone to Commonwealth St and behind to Mary St.

It is proposed the No Parking zone become a Bus Zone with existing periodic Clearway and No Stopping conditions remaining.

Bus operators are aware of the tree overhang which exists just prior to the proposed location and is not considered an impairment given buses use this lane now.

Consultation may be required for this proposed location.

Bus stop 201514 – Mitchell Rd at Maddox St, Alexandria

Issue:

The head of stand at this stop has always been ahead of the forward Bus Zone due to the restricted length of the zone. TGSI are already provided at this location.

Proposed solution:

The formal establishment of the Head of Stand with a B Pole sign is proposed to be 2300mm ahead of the existing forward Bus Zone sign.

The Bus Zone / No Stopping sign would be relocated 5400mm ahead of its current position.

Extending the Bus Zone forward will not impede current parking arrangements.

However, there is painted chevron island at the proposed Head of Stand that may need to be adjusted.

Bus stop 201554 – McEvoy St after Botany Rd, Alexandria

Issue:

A new QMS shelter has been installed closer towards the forward Bus Zone sign to the west. Subsequently this has left insufficient space to install a Head of Stand B Pole sign.

There is also a No Stopping zone ahead of the Bus Zone.

Proposed solution:

Relocate the Bus Zone / No Stopping sign 880mm forward of its current location.

The Head of Stand B Pole would then be installed 1570mm forward of the new QMS shelter.

Extending the Bus Zone will not impede current parking arrangements.

Bus stop 201572 – Mitchell Rd after Fountains St, Alexandria

Issue:

A new QMS shelter has been installed closer towards the forward Bus Zone sign to the north. Subsequently this has left insufficient space to install a Head of Stand B Pole sign.

There is also a No Stopping zone ahead of the Bus Zone and then a 40 Zone due to a school nearby.

Proposed solution:

Relocate the Bus Zone / No Stopping sign 3070mm forward of its current location.

The Head of Stand B Pole would then be installed 1570mm forward of the new QMS shelter.

Extending the Bus Zone will not impede current parking arrangements.

NOTE: This is considered an interim solution pending review of the potential impacts of a proposed signalised pedestrian crossing at the traffic signals behind this stop.

 

Bus stop 202193 – The Entertainment Quarter, Lang Rd. Moore Park

Issue:

A new QMS shelter has been installed closer towards the forward Bus Zone sign to the east. Subsequently this has left insufficient space to install a Head of Stand B Pole sign.

There is also a No Stopping zone sign with the forward Bus Zone sign covering up to the next intersection at Cook Rd.

Proposed solution:

Head of Stand B Pole sign is proposed to be placed where existing forward Bus Zone / No Stopping sign is located.

The existing Bus Zone / No Stopping sign would be relocated approximately 1850mm to the east of its current location.

Bus stop 204313 – Erskineville Rd before Charles St, Erskineville

Issue:

A new QMS shelter has been installed closer towards the forward Bus Zone sign. Subsequently this has left insufficient space to install a Head of Stand B Pole sign.

There is also a No Stopping zone sign with the forward Bus Zone sign covering to the end of the recessed bus bay.

Proposed solution:

Head of Stand B Pole sign is proposed to be placed 1200mm behind the QMS shelter.

The existing Bus Zone / No Stopping sign would be relocated approximately 8350mm forward of its current location. It would be 1450mm before the Pedestrian Crossing sign.

Bus stop 205029 – Salisbury Ave at Church St, Camperdown

Issue:

A new QMS shelter has been installed closer towards the forward Bus Zone sign. Subsequently this has left insufficient space to install a Head of Stand B Pole sign.

There is also a No Stopping zone sign with the forward Bus Zone sign covering to the intersection of Church Street to the north.

Proposed solution:

Head of Stand B Pole sign is proposed to be placed where existing forward Bus Zone / No Stopping sign is located.

The existing Bus Zone / No Stopping sign would be relocated 1100mm to the north of its current location. It would be 6900mm from the intersection with Church Street.

(6)            FLOOR SPACE RATIO

(33)        SYDNEY AIRPORT CORPORATION LIMITED / DEPARTMENT OF    INFRASTRUCTURE, TRANSPORT, CITIES AND REGIONAL DEVELOPMENT

(a)        The building must not exceed a maximum height of 167.4 metres 175.6 metres AHD, this includes all lift over-runs, vents, chimneys, aerials, antennas, lightning rods, any roof top garden plantings, exhaust flues etc.

(b)        Separate approval must be sought under the Regulations for any equipment (i.e. cranes) required to construct the building. Construction cranes may be required to operate at a height significantly higher than that of the proposed controlled activity and consequently, may not be approved under the Regulations. Therefore, it is advisable that approval to operate construction equipment (i.e. cranes) be obtained prior to any commitment to construct.

(c)        The Proponent must advice advise Airservices Australia at least three business days prior to the controlled activity commencing by emailing ifp@airservicesaustralia.com and quoting YSSY-CA-216.

(d)        On completion of construction of the building, the Proponent must provide the airfield design manager SACL with a written report from certified surveyor on the finished height of the building.

(e)        A separate assessment and approval under the Regulations will be required for any further addition to the height of the building (including the installation of antennas) as it will increase the penetration of the OLS.

(f)         Breaches of approval conditions are subject to significant penalties under Sections 185 and 187 of the Act.

Reasons for Decision

The application was approved for the following reasons:

(A)       The development, as modified, is substantially the same development as that originally approved and is consistent with Section 4.55(2)(a) of the Environmental Planning and Assessment Act, 1979.

(B)       The proposed modifications ensure that the detailed design development application is consistent with the concept approval, in order to satisfy Section 4.24 of the Environmental Planning and Assessment Act, 1979.

(C)       The proposed modifications are consistent with and are considered acceptable having regard to the reasons given for the original approval in accordance with Section 4.55(3) of the Environmental Planning and Assessment Act, 1979.

(D)       The proposal is consistent with the aims, objectives and relevant provisions of the Sydney Local Environmental Plan 2012 (SLEP 2012) and Sydney Development Control Plan 2012 (SDCP 2012) for the reasons set out in the report.

(E)       The modified building envelopes can accommodate a building design which is capable of exhibiting design excellence in accordance with Clause 6.21C of the SLEP 2012.

(F)       The increased height and bulk of the building envelopes are in keeping with the desired future character of the area. These variations are reasonable and justified with regard to the concurrent detailed design development application D/2022/481.

(G)      The changes to the approved building envelopes are appropriate and are not likely to significantly impact the overall use of the building or the amenity of surrounding sites or locality.

(H)       The development as modified is in the public interest.

Reason

To ensure the allocation of parking is in accordance with the Council’s Development Control Plan.

Reasons for Decision

The application was approved for the following reasons:

(A)       The proposal satisfies the objectives of the Environmental Planning and Assessment Act, 1979, in that, subject to the imposition of conditions as recommended, it achieves the objectives of the site's planning controls for the reasons outlined in the report to the Central Sydney Planning Committee.

(B)       Based upon the material available to the Committee at the time of determining this application, the Committee is satisfied that:

(i)         the applicant’s written request has adequately addressed the matters required to be demonstrated by clause 4.6(3) of the SLEP 2012, that compliance with the Height of Buildings development standard is unreasonable or unnecessary and that there are sufficient planning grounds to justify contravening clause 4.3 of the SLEP 2012; and

(ii)        the proposal is in the public interest because it is consistent with the objectives of the SP5 Metropolitan Centre zone and the Height of Buildings development standard.

(C)       Based upon the material available to the Committee at the time of determining this application, the Committee is satisfied that:

(i)         the applicant’s written request has adequately addressed the matters required to be demonstrated by clause 4.6(3) of the SLEP 2012, that compliance with the Floor Space Ratio (FSR) development standard is unreasonable or unnecessary and that there are sufficient planning grounds to justify contravening clause 4.4 of the SLEP 2012; and

(ii)        the proposal is in the public interest because it is consistent with the objectives of the SP5 Metropolitan Centre zone and the FSR development standard.

(D)       The proposal is consistent with the objectives of the SP5 Metropolitan Zone of SLEP 2012.

(E)       The development, subject to conditions, is generally consistent with the applicable State Environmental Planning Policies, the Apartment Design Guide (ADG), the SLEP 2012 and the Sydney Development Control Plan 2012 (SDCP 2012).

(F)       The built form is of a high quality and consistent with the future desired character of the area. Subject to conditions, the proposed development is considered to exhibit design excellence and will make a positive contribution to the public domain and the Sydney skyline and streetscape.

(G)      The proposed development is consistent with the design intent of the winning scheme of a competitive design process, held in accordance with the City of Sydney Competitive Design Policy.

(H)       The proposed development is consistent with the amended concept approval for the site, being D/2019/758/A, in accordance with Section 4.24 of the Environmental Planning and Assessment Act, 1979.

(I)         The proposed development has a height, scale and form suitable for the site and its context, and subject to conditions, satisfactorily addresses the heights and setbacks of neighbouring developments, is appropriate in the streetscape context and setting of the broader locality.

(J)        Subject to the recommended conditions of consent, the proposed development achieves acceptable amenity for the existing and future occupants of the subject and adjoining sites.

(K)       The proposed mix of compatible land uses will support the vitality of the area and do not result in any significant adverse environmental or amenity impacts on the subject or surrounding properties, the public domain and the broader Sydney Central Business District, subject to the recommended conditions.

(L)        The public interest is served by the approval of the proposal, as amendments to the development application have addressed the matters raised by the City and the community, subject to recommended conditions imposed relating to the appropriate management of potential environmental impacts associated with the development.

(M)      For the reasons above and as detailed in the assessment report to the Central Sydney Planning Committee, the proposed development is in the public interest subject to conditions.

(N)       Condition 53 was amended to clarify that a development application/s is required for the fit out and operational details of the uses located within the podium.

(O)      Condition 62 was amended to reflect the correct car parking and motorcycle parking allocation as shown in the assessment report and accompanying architectural plans.
