Moved by Councillor Forster, seconded Councillor Chung –

It is resolved that:

(A)        Council note:

(i)          Action 1 of the City of Sydney's discussion paper, 'An Open and Creative City: Planning for culture and the night time economy', provides for shops and local businesses in areas with an established retail character to extend their opening hours without a new development consent from 7am to 10pm, seven days per week;

(ii)         community feedback included strong support for shops and local businesses in established retail areas to be able to trade from 7am to 10pm, seven days a week, without requiring additional development consent;

(iii)        feedback resulting from a review of late-night trading in Sydney also included strong support for an increase in trading hours for late-night premises across the city;

(iv)       at last month’s 26 October 2020 Council Meeting the City’s ‘Al Fresco City’ item was carried unanimously. The initiative is a $20 million joint funding partnership aimed at boosting city centre economy, supporting businesses and creatives and inviting the public safely back into the city, particularly during the summer months;

(v)         a new provision has been inserted into the City’s Outdoor Dining Guidelines to allow maximum trading hours to be approved with reduced or no trial periods given the temporary outdoor dining approvals will only be in place until 31 October 2021; and

(vi)       the Guidelines refer to the City's late-night trading controls in Sydney Development Control Plan 2012 (DCP). Under the DCP, maximum trading hours for outdoor dining areas are 1am in 24-hour late-night management precincts, 11pm in City living precincts and 10pm in local centre precincts; and

(B)        the Chief Executive Officer be requested to:

(i)          investigate the possibility of offering free parking after 7pm in the two City-owned car parking stations; and

(ii)         report back to Councillors the results of that investigation via a CEO Update as soon as practicable.
